selling of govt land to promoters

75 feet on either side of Grand Trunk road (NH2) belonged to the central government.when a byepass was constructed outside the town the municipal corporation presumed the said 75 feet of land as thier own personal property and allowed a local promoter to build multi storey commercial complexes only 10-15 feet away from the road. now when the entire strech of GT road has been widened,the 500 mtr strech pasing by the complex is still single lane. efforts by several groups to file PIL were suffocated. is it a fit case for CBI TO PROBE? HOW CAN THE CBI BE APPROACHED

CBI will not take up such assignment nor would any court burden the CBI with this kind of cases. You have to approach the High court by a writ of mandamus against the govt authorities who have failed to take action in this regard. Since it is a matter of public interest,the High court would definitely come to your rescue.

Write to the National High Way Authority of India under Registered post ack. due. If no reply is received, then ask for the information about the fate of the complaint through RTI to NHAI. Thereafter if you still feel that you have a strong case, proceed to file a writ petition in the High Court citing all the relevant documents.

You cannot approach CBI. Your problem is specific and a civil case. You are at liberty to file a civil suit if you are a sufferer. If not, you have no case to approach either CBI or court.

Fail to understand, why the CBI will not take up the case. It is an open secret that crores of rupees have changed hands.The Mayor was also involved. The matter was hushedup in Parliament. I resposible government officer, who prefers not to be quoted had said that government land on either side of the road is meant for public services, parking, garden and beautification.

More important, The Land belongs to the central Government. How can the municipal cOrporatiuon lease it out. how can the Corporation sancrtion the plans.

Since the land belongs to the Central Govt. you should alert the concerned department of the Central Govt for taking necessary action. you may also consider media publicity so that the vested interests would not be in a position to suppress the matter and concerned authorities would be forced to take action. I do not recommend any legal action by you directly.
