Road distance

sir , facts of matter are that H.P. govt. is deputing water career in Govt school .besides other marks 10 marks are of distance from concerned school . if distance of applicant from school is more than 4 Km then applicant will be entitled for 2 marks and if the distance is below 1.5 km applicant wil be entitled for full 10 marks . in present case at the time of selection candidate whose road distance is more than 4 km awarded 10 marks . my client filled civil writ petition in high court of h.p and high court directed the chairman of appointing committee ie sdm to decide the matter afresh within 3 months . my client house is 1 km from school . in these circumstances SDM visited the spot and measured the short cut way only to upheld his appointment however road distance of that person is 4 kilometer from school and i have also tendered certificte of PWD department in evidence and assistant engineer of pwd was also summoned to exhibit the said certificate . with regard . Dear Neeraj,

The PWD being the related agency about buildings and roads, only the certificate of the PWD would be valid, not the measurement made by the SDM himself. Shortcuts are never the right yardsticks to be followed in official references. So, the SDM should not have gone beyond the scope of his own sphere of officially delegated/ assigned duties and responsibilities by interfering in the domain of other Government agencies.
