Residential Land for Temple

(Querist) 25 March 2009 This query is : Resolved 
what is the procedure to use the residential land (House constructed) for temple. The temple is to be constructed by the land owners of that residential land. suggest a remedy that results in least cash outflow? Should it be registered again in the name of temple trust paying stamp duty? Take into consideration Tax effects and also property registration rules/act. Pl explain in detail. Pl help me out in this issue

in my opinion no permission is required, but it is better to get approval from the concerned muncipality and Town Developmentg authority.

My query is how to transfer the ownership in the name of temple? Is that to be done by registering again by paying stamp duty because anyway the persons associated are the same ie., owners of the residential land who are going to construct the temple?

Create a private trust of the temple and show the land as property of the trust. Once the property is shown as property of the trust, there should not be any problem for mutation in favour of the trust i.e. temple in the record of rights.

Eneter ointo a trust deed and get permission form the local authorities. Once the temple is constructed the land becomes the land of the temple no body can demolish it there after.

Thanks 4 ur suggestions. can u tell me is there any key point which is to be specified in the trust deed to make the land property of the temple? I'm a CA student and have no idea in this area. Pl guide me to have a clear idea.

Prasanna better u consult some local lawyer for this issue, reason being land laws in every state are different.
