Rent deposit

(Querist) 21 September 2016 This query is : Resolved 
I have paid retal advance(Total advance Rs.60,000) of Rs. 30K as on 17/08/2016 for rental house advance and due to my personal problems I cant change my home to new rental house. I have informed her within 10 days from advance amount paid.


However, She required Rs.10k for that 1 month (Monthly rent 10,000) and she will provide only 20k out of 30k to my hand.

I am not having any evidence for this transaction. As she did not give any receipts for that advance amount.


Please legal advise if she deduct that 10k shall I sue and get that amount and claim legal expenses if i sue on her.

Quite a vague query!

How legal advice can be expected without discussion of case history and the nature of transactions 10, 20k or 30k, etc. Also, what connection of 10, 20, 30k is there with the advance rentals of 60k?

Advance paid by cash.

Landlord demanded Rs 10,000 for loss of rent.

If you don't have any evidence of payment, you would be benefitted if the landlady is ready to return even Rs.20k. She can claim rent for one month for non-occupation, as she could not allow any other tenant ever since 17.08.2016 due to deal with you.

I do agree with the observation of Ld. Dhingra Sir. Your landlady is quite honest as she has rightly deducted Rs. 10,000/- and has agreed to return you rest of advance amount.

Practically landlord is justified in deducting one month rent.

Any Legal action from you would be more cost and time consuming.

If possible, write politely to land landlord thanking him providing his premises for you but unable to change home. Finally but honestly state the amount you paid to him in detail. It is expected that he may write back in reply the amount so paid or otherwise,and keep this as a proof and hit back on appropriate time as an evidence.
