Being property of your father, as per law your brother has equal right on the property but as you said that he wishes to give away his part ask him to sign a relinquishment deed.

Your brother can relinquish his rights through a deed and after it you can get it in your name. If mother is also alive she also has to register her relinquish deed in the same manner.
