Registering a gift deed with the sub registrar, after notary

Querist : Anonymous (Querist) 19 December 2023 This query is : Resolved
Sir,

There is a gift deed that was Notarised on 10.09.23, but now the Donor & the donee want to register it with the Sub Registrar paying stamp duty.

IS IT POSSIBLE TO REGISTER THIS SAME NOTARISED GIFT DEED WITH THE SUB REGISTRAR, IF YES, WITHIN HOW MANY MONTHS OF BEING NOTARISED, CAN THE SUB REGISTRAR REGISTER IT OR ITS NOT POSSIBLE TO REGISTER A NOTARISED GIFT DEED.
Quick Summary
A gift deed was notarised on 10.09.23, and the donor and donee now wish to register it with the Sub Registrar, paying stamp duty. The key question is whether a notarised gift deed can be registered, and if so, within what timeframe. Generally, a deed can be registered within four months of its execution. However, the notarisation itself does not constitute valid registration, and the Sub Registrar requires proof that notarised deeds are acceptable for registration.

A deed can be registered within four months of its execution, hence you have another 20 days within which you can register the gift deed.

When did the gift deed execute when it was notarized on 10.09.2023? The time to present any deed is within 4 months from the date of its execution. Notarization of the Gift deed is not valid.

Thank you,

THE GIFT DEED HAS A NOTARY STAMP ON IT, CAN THE SUB REGISTRAR ACCEPT IT. HE HAS TOLD ME TO SHOW HIM PROOF THAT NOTARISED GIFT DEEDS CAN BE REGISTERED WITH THE SUB REGISTRAR AFTER HAVING A NOTARY STAMP ON IT.

PLS CLARIFY.
