Regarding stamp duty

(Querist) 01 May 2021 This query is : Resolved
we have paid stamp duty on 2nd april 2021 as the govt site was not working can it be adjusted against stamp duty ded rate upto 31st mar 2021
Quick Summary
This discussion clarifies that stamp duty paid on 2nd April 2021 cannot be adjusted against rates applicable before 31st March 2021. Stamp duty is generally calculated based on the rates in effect on the date the document is registered or the payment is finalised. While a non-functional government website might offer grounds for appeal, the payment made on 2nd April will typically apply to transactions from that date onwards, not prior ones.

If the stamp duty rates changed, after 31, the stamp duty shall be applicable at prevailing rates on 2nd April unless leave is granted otherwise on account of non functional website.

Hello,

Stamp duty paid on 2nd April cannot be presumed to be paid as per stamp duty rates applicable before 31st March. Stamp duty rate applicable when the document is registered.

Your query is not clear. on 2nd April 2021 you paid an amount from your bank account, and not fed into the records of the Sub Registrar, it should be not materialized from your Bank account

Facts posted lack clarity.
If the amount was paid on 02.04.2021 how it can be adjusted for stamp duty on 31.03.2021 ? If it is so, answer is "No".
T. Kalaiselvan, Advocate (Expert) 02 May 2021
The stamp duty paid on 02.04.2021 shall be adjusted towards the transaction held on or after that only and not for the transaction done prior to that date.
For whatever it may be worth, you may once again clarify the details from the concerned registrar's office to have more clarity on the subject
