Regarding resignation

I am a central Govt Employee. I would like to resign my post due to personal reasons. My reporting manager has accepted and forwarded my resignation to our Director(of my organization). Director denies to sign in my resignation form and process further, due to shortage of staff. What can i do now, if i will not be formally relieved in three months of notice period?.

Acceptance of the resignation by the competent authority is necessary within the notice period.

if there is notice period mention in your appointment letter, you should follow the terms and condition otherwise you would be pay the amount.

see the clause whch explains resignation in ur appointment order or the service rules of that department. u will come to know. if u can comply the same then u should be relieved compulsorily.

If no response is received to your resignation notice during the notice period, the resignation is deemed to have been accepted and becomes effective from the due date for resignation.

Of course, Mr. Gupta, the expiry date of notice would be the effective date of resignation.

(12) Resignation from Service procedure in respect of :-

Instructions have been issued from time to time on the subject of resignation. These instructions have now been consolidated for facility of reference and guidance of all the Ministry/Departments of the Government of India.

1. Resignation is an intimation in writing sent to the competent authority by the incumbent of a post, of his intention or proposal to resign the office/post either immediately or from a future specified date. A resignation has to be clear and unconditional.

2. it is not in the interest of Government to retain an unwilling Government servant in service. The general rule, therefore, is that a resignation of a Government servant from service should be accepted, except in the
circumstances indicated below :-

FROM ABOVE RULE IT TRANSPIRES THAT RESIGNATION SHOULD BE ACCEPTED.
But without accceptance of resignation letter and relieving order it will be very difficult to process your pension etc.. papers so it will be in your interest to file application in the central administrative tribunal of your state where you are residing after resignation asking prayer to direct resignation to be accepted and pay retiral/terminal benefits of GPF,Pension,leave encashment,gratuity and any other benefit of group insurance etc.. if any such scheme exists in your department.
Before filing application in cat give proper notice of about one monthh.Legally it is not necessary but you should satisfy the tribunal that you have exhausted all the remedy available.It is not necessary to have an Advocate in cat you can file yourself appearing personally.But engaging advocate will be better for pursuing matter with cat.
