Regarding recruitment rules.

Sir,

In the recruitment rules in column no. 5, in some posts written as 'Selection' and in some written as 'non-selection.

1. What is difference between in both.
2. How the reservation roster is implemented in promotion where 'selection' is noted in column '5' in RR and total 315 posts are vacant.

Selection means promotion by seniority cum merit. If one has seniority but do not qualify under merit, will not be promoted.

On the contrary non-selection means, it is seniority cum fitness. One will get promoted on the basis of seniority and merit will not come in the way.

Seniority list is common for both.

Dear Goyal Sir,

There is 142 posts were in a cadre and there are 14 SC incumbents through roster points. But now department has restructed the cadre and increased 283 posts and now after restructuring 425 posts is sanctioned strength.

Now our department saying that they will maintain roster and (14 before restructuring) +49=63posts will gone to SC incumbents.

My view is that when in Recruitment Rules column 5 is 'selection' then why 63 posts gone to SC incumbents. They should be promoted by their own merit not by roster.

You are nobody to dictate.
As per law, posts have to be reserved for SC/STs.
After such reservation, even those SC/ST candidates will be promoted to the reserved post only on their merit.

Anirudh sir, i am not dictating but some officer told me that while in the Recruitment Rules 'Selection' is marked in column '5' and posts are 100% by promotion in that case the roster is not maintained and SC/ST incumbents will be promoted only on their merit and not by any roster point.

What is the cadre status of the employees, i.e., Group A, B, C, or D from which panel has to be made for promotion and to which ultimate status/group of the posts?

You said that "They should be promoted by their own merit not by roster." Obviously, this is nothing but dictating!

When the post is promotion by 'selection' I already informed you that apart from seniority, merit will play the role.

Therefore, even in the case of SC/STs they will be promoted on the basis of their seniority+merit BUT against their reserved quota.

Your officer who told you otherwise is not correct.

Reservation roster has to be applied in all cases for prmotion from lower posts up to the level of Group A level. Recruitment rules need not not mention reservation of posts.

Selection based on seniority cum merit obtained i ACRs/ APARs, whereas in non-selection cases only seniority becomes the criteria of selection.

For reservation point of view in selection based posts unfilled vacancies, including the carried forward unfilled vacancies of the past years for reserved categories have to be taken in to account as per the roster and selection would depend on the seniority cum merit separately in reserved classes and others and nerit has to be decided based on the scores earmarked to each condidate. Even a meritorious SC/ST candidate can find place in non-reserved category for inter-se seniority purpose, but would be adjusted in the roster against one of the reserved vacancy to ensure that reserved category candidates should not exceed the total No. of reserved vacancies..
