Hi,
My friend has a possetion of land from last 10 years and his name mentioned below on 07/12 document of land as a possetioner. The name of his Aunty is mentioned above as a owner on 07/12 paper of land.
But three to four months before , Aunty sold the land to third persone with less amount without my friend's consent. My friend took the photocopy of sell dead from ragistration office and then he came to know that the land has been sold by his Aunty with less amount.
Could you please advice reagrding below queries.
1) Whether Aunty has a right to sell the land or she has to take consent of my friend
2) If Aunty can not sell the land without my friend then can my friend file cheating case that means case under IPC 420 against Aunty and also against the persone who bought the land. Can my friend do that.
3) Can he file the case in trial court to challenge the sell dead. can he file the case for cancellation of sell dead. Is there any chances to cancel the sell dead and win the case.
