Refund of NJ stamp papers

I have purchased a property from "X" and got registered with the Sub-Registrar. Next day I was informed by the Sub-Registrar that the deed executed has to be cancelled as the property dealt is attached by Registrar of Co-op bank & refused to give the sale deed executed. A written statement has also been obtained by me from the Sub-Registrar to this effect to cancel the deed executed.

My query is

- In case I cancel the deed executed based on the advice of Sub-Registrar, whether I can surrender the the NJ Stamp papers for refund
- If so whom should I surrender
- Can I get full refund of the value of stamp papers used

First you will have to contact the Owner, as you have paid him/her the money. Once all that is done, then you will have to make an application to the office of the Sub registrar, where they also have a form to be filled. You will have to get the consent of the other party also, as the other party would be under the impression that the document is registered. After complying with the requirements of the concerned officer, you will get the full refund after a month or so.

You have not given the details where was the document registered. It would be easy to guide you to whom to contact, if you give more details about the place of registration.

The registration was done at Sub-Registrar office located in Tamilnadu.

Since I have received intimation from the Sub-Registrar immediatelyafter registration, I have withheld the payment. The party is willing to cancel the deed. Under the circumstances, on cancellation of the deed & on receipt of the stamp papers used from the Sub-Registrar, whether I can get refund on the value of the stamp papers already used. If so, whom I should surrender the stamp papers.

In the above circumstances it seems that you are eligible for refund. check the time limit for refund.
