Recovery suit

(Querist) 17 April 2008 This query is : Resolved
Dear Friends,

Can anyone tell me how the courts will recover money in civil suits from the respondent in cases where there is no property to be attached

Is there any other way out or imprisonment which the courts will impose on the respondent.

if he is having source of money, certainly you can ask the court to put him in the civil prison, but the petitioner (decree-holder) is liable to pay his expenses(diet money)
please read O.21 Rule 30 of CPC

If he is in service, recovery may be made by way of attachment of salary,pf etc.
