Q-1: Whether a Complainant,–
-“after a counter-FIR of non-cognizable offence lodged on her behalf as a counter to an FIR of cognizable offence lodged against her and others in connection with an occurrence-
-and-
-in pursuance thereof the jurisdictional police submitted their report u/s 173(2) of Cr.P.C. against her and others and cognizance was taken thereof by the Jurisdictional Court and criminal proceedings instituted thereto”,-
-can file a fresh FIR,-
-“on alleged allegations pertaining to past to the said occurrence, about different cognizable offence alleged to have already been committed in territorial Jurisdiction in which the said criminal proceedings is going on”,-
-with the police of other territorial jurisdiction?
Q-2: Whether a Complainant, can file an FIR of Cognizable offence,-
-“in respect of a Cognizable offence alleged to have already been committed at the time when she preferred to lodge an FIR of non-cognizable offence allegedly committed against the accused in the same territorial Jurisdiction”,-
-in the police station of other territorial Jurisdiction?
NOTE:
(Are there any other legal parameter is required to be answered in respect of the above to decide the said questions of Law?)
(Whether these questions of law are fit to be decided by the Apex Court of the Land?)
