A person having law degree but he is not enrolled with any state bar council, he is only income tax practitioner.


1. can he write himself as a non practicing advocate ?

2. can he use Advocate before his name.

3. if he published advocate before his name in a newspaper. Where complaint against said person can be made and what is the penalty imposed on him/her by that organisation.

A person who is not enrolled as an advocate with a Bar Council of a state is not an advocate.

Such a person has no authority to use the title advocate before his name. If he is using, it is a misrepresentation of fact and a punishable offence.

Prefixing any title has been debarred by the framers of Constitution, except military rank and academic excellence.
Till a person is not enrolled in any Bar Council s/he is not an "advocate", read the provisions of Advocates Act, 1961.

yes, sir, I know that person, he always writes that he is not a practicing advocate. but he uses an advocate before his name.

is this possible to know that he enrolled in any bar council in India ?
is bar council of India prepare the list of all enrolled advocates in India? so that I file an RTI for that purpose. ?

is an advocate which enrolled in state bar council but he is not practicing, is he write advocate before his name?
