Provident fund office is reluctant to give back the provident fund amount.There is no liability or any other liability pending.Can I file case before High Court or I want to send a legal notice to the Provident Office?Thank you.

WHEN A PERSON RESIGN FROM HIS SERVICE HE HAS TO WAIT FOR 60 DAYS FROM THE DATE OF RESIGNATION TO FILE HIS CLAIM FORM IF HE IS SUPER ANNUATED NO TIME FRAME.FORM-19 AND FORM-10C IS AVAILABLE AT THE NEAREST EPF OFFICE ON FREE OF COST. GET IT FILLED WITH ALL MANNER AND TO BE COUNTERSIGNED BY CONCERN EMPLOYER THEN ONLY IT IS TO BE FILED BEFORE THE AUTHORITY FOR REFUND OF YOUR ACCUMULATIONS.

u r correct and u have full right to get ur savings by way of pF. No one have right to stop ur clims, if ur employer do it , then u send the settlement form to concern regional PF office along with ur prop with ur employer, The commissionor direct the employer to settle ur pf amount.
So as simple as u have full right and eligible to get ur money , but asper mr A.R kupusami's explanation, u have to wait till 60 days from the date of resignation. u have eligible to file the application only after the stupulated date of 60 days. From the filing date u get the amount with in 30 days.All these days ur money will enjoy the interst.

if after filing the application,your pf is not paid within a reasonable time of 30 days, raise an rti for the same asking the present position of your case with the file movement details and notings on the file etc to the PIO of the concerned PF office before moving to court.

You may initially represent about the delay to the Regional PF Commissioner who would get the complaint looked into and expedite the refund of your legitimate dues
