Ownership of Hut Premises

Sir/Madam,
My father had his own self aqquire hut premises and it was purchase somewhere in 1970's when the documentation of sale was not in picture as at that time no sale deed document require/necessary to purchase the hut premise. My father death occured in Oct 2005 and that time one tenant was statying in the hut premises. After my fathers death my uncle (father's younger brother) came to us and demaned for the above hut premises, when we did not give it to him he made some forgery documents such as nationality ID, ration card,Electricity bill , etc. Now as per the law the property should be transfer in the name of my mother. We only have Census slip which was given by BMC in the year of 2000 on the name of my father.
Please guide me if my mother has another flat on her name then can she not get the benefit of the hut premises and what will be the best way to aquire that hut premises?
