Notice to partner at his residence in sec 138

(Querist) 12 July 2013 This query is : Resolved 
A cheque was returned back issued by a partnership firm. Under sec 138 notice was given to one partner to his residence address without mentioning the firm name or address. Except the cheque he has no record to prove that he had given the amount. In the notice he has mentioned as hand loan was given to the accused. Can the above 2 points be advantage to the accused.
