Nature of the property?

Querist : Anonymous (Querist) 23 July 2011 This query is : Resolved

Dear Experts, I have learnt that Property acquired by way of “will” is self acquired one. Now I want to know:-
(1) If a person receives the ancestral property from his father
during his lifetime by decree of court.
(2) If a person receives the self acquired property from his father during his lifetime by decree of court.
What will be the nature of that property(whether self acquired or ancestral) in above two cases?

Treated as self acquired.

(1) If a person receives the ancestral property from his father during his life time by decree of court - WILL CONTINUE TO BE ANCESTRAL PROPERTY in the hands of the son.

(2) The question of acquiring by decree of court, any self acquired property of a father by his son does not at all arise. The fact situation may be completely different and not the one given by you.
