Maintenanance

Respected Seniors,

Old age parents ready to file a petition u/s 125 of Cr.P.C. by praying maintenance against their daughters since they are having no sons.

In this aspect i require some decisions infavour of the old age parents against their daughters.

In Vijaya Manohar Arbat Vs Kashi Rao Rajaran Sawai (AIR 1987 SC 1100)the SC held that a daught married or unmarried having sufficient means is liable to pay maintenance to her father or mother who is unable to maintain himself or herself.

Daughter has liability to maintain her father, mother or both, when those parents are unable to maintain their self.

Father or Mother can seek maintenance under Section 125 or Cr.P.C
