Legal implication of using famous hindi movie dilogue

Dear Friends,

If a company use a famous movie dilogue in the label of its production for compign/advertisment is the company liable for any liability under any indian IPR laws or any other civil/criminal liability arises on the Company.

Company needs to purchase the rights of such re-production for its business purpose from the producer/distributor of the film.

Thanks a lot. Suppose if the company make a picture in the pack of its product which resembles a scene of a famous bollywood and places a dilouge of the same movie but different words, then also it covers under Copy Right?

In my view this kind of advertisment is not infringement of copy right because the copy right subsists in original litrary,musical and artistic works,cinematograph films and sound recording and this kind of advertisments are very common and do not fall within the ambit of above criteria of copy rights.

Depends upon how your company is able to defend its position by justifying the change in words of dialogue and the scene. Hypothetic query is useless, unless you provide wording of the original dialong with description of scene along with the modified language of the dialogue. Mere presumption cannot serve your purpose as legal implications depend upon the specific matter, circumstances and proof in favour or against a particular matter.
