Joint ownership by Indian citizen and NRI

Querist : Anonymous (Querist) 27 November 2010 This query is : Resolved
I am buying a property jointly owned by brother and his married sister who is an NRI. It seems that she has given GPA to her brother. Is it safe to buy the property from the brother who will also act as GPA for his sister? Will the sister or her husband or the children create trouble in future?

this is not resolved because no answer to my querry since following issues involved:
a) Whether sisters husband all major children should give NOC?
b) Similarly whether brother's wife, and major children should give NOC?
Kindly enlighten me.

If the GPA is valdly executed and the same is in force at the time of execution of sale deed then there iis nothing to worry as such. If the property of the seller is self acquired then no NOC is required either.
