improper date on cheque

(Querist) 30 April 2008 This query is : Resolved 
My customer give me a cheque of dated 31-04-2008.In fact month of April is always of 30 days.Now he is not co operating with me.what i have to do now.

File a criminal case under section 420 IPC
and recover the liability in civil case with proof of issuance of cheque.
