Please let me know
If Husband and wife work in the same station, and live together but not provided with Government accommodation. only one or both will be entitled to draw HRA.

Dear Mr. Raghwendra,
If Govt. accommodation or Company Accommodation is not provided, then both husband and wife are entitled for HRA in their own right. Nobody will be able to stop it. (I am not sure whether your Transfer Grant problem has been solved or not).

For HRA there is no separate reference is required. Each of the employee is entitled to the same. Only if the Administration denies grant of HRA to anybody, then they have to show the relevant Rules for such denial. Therefore, if any one of you (husband or wife) is not granted the HRA, that that affected person has to simply make a representation that it is seen that HRA has not been given. This may please be given to me. That is all. Each of the month when the HRA is not given, such a representation for each of the month may be given. Please take acknowledgement for each of the representation.

If they are not giving the HRA or suitably reply why they have not given the HRA then come to me. But after giving representation do not unnecessarily discuss these things with anybody including with your colleagues. Simply keep quiet as though nothing has happened. Many cases get spoiled only when we show unnecessary anxiety or extra enthusiasm or go on lament about our grievance and how injustice has been done to us etc. etc. Even if some of the colleagues provoke you or your wife, simply say that let us say what happens, we have given representation the outcome is not known.

I have not discussed this issue to any body except taking guidance from this forum.
Sir They are refusing HRA to my wife since last three months on the ground that we are living togather in Rented accomodation.
I need your guidance for the same

As I already informed you, please ask your wife to make a simple representation to the Accounts Officer or PAO concerned stating that she has not been given HRA for the past three months. That she may be given the HRA due to her according to rules.
Take proper acknowledgement for such representation or forward it through proper channel.
Thereafter, if the same is not granted even in the next pay bill, send a Reminder-I, mentioning the first representation and that so far not only the past arrear has not been paid, but even for the current month the HRA has not been paid.
Wait for 1 more month, do the same thing for the next month by Sending Reminder-II.
If nothing happens for 1 more month, come to me.

even though both wife and husband are government employees, and qovernment accommodation is not provided, both are eligible for claiming hra.

Remaining things can be followed as suggested by Sri Ramachandran Sir.

It is settled position, only one of the spouse is entitled for HRA under the circumstances as stated in query.

Dear Raghwendra,

I would like to supplement the reply of Shri Ramachandran along with Government ruling on the subject.

Government of India long back in 1988 have clearly decided and directed vide Ministry of Finance Office Memorandum No. F.11015/2/87-E.II (B), dated 8.11.1988 that NO RESTRICTION SHOULD BE IMPOSED ONLY ON THE GROUND THAT HUSBAND/WIFE IS LIVING TOGETHER IN THE HIRED/OWNED ACCOMMODATION. IN SUCH CASES, NORMAL AMOUNT OF HRA MAY BE GRANTED TO THEM AS PER THEIR ENTITLEMENT.

So, your wife can represent on the lines quoting the ruling and get some definite reply from the PAO/ Drawing & Disbursing Officer of her office.
