Gda (gwalior development authority) refusing mutation

Hello,

I purchased a plot from cooperative housing society in 1996 with registration approved and mutation done by Gwalior development authority in 1997. The plot is registered with mutation along with map and residential development approved by GDA itself. As I want to resale my plot to another person/party, GDA is refusing to provide a NOC for the resale and mutation of the property in another party's name for reasons they have chosen not to disclose to me. Despite repetitive efforts, GDA staff is not helping me with proper reasons due to which I am unable to sell my property and causing me a lot of financial troubles.

What should be the ideal way to deal with this situation. Any legal guidance from an expert is recommended. Please help.

Mutation of property in Gujarat involves updating the Record of Rights (RoR) after a property transfer, via any ROR portal or local revenue/municipal offices. You shall submit a registered sale/gift deed (Form 6) to the Talati, with a 15–30 day process.

You can obtain information about the status of your application for mutation and then proceed legally.
However since the property is already mutated to your name, it will be the duty of the buyer to get it mutated after purchase formality is completed.

When the property is "freehold" is NOC required fom GDA for sale ? Did you meet Commissioner / concerned highest official of GDA with facts / documents ?

When all alternatives fail you may issue legal notice to GDA followed by a suit for mandatory & permanent injunction through a local prudent lawyer.

Hello Sir,

Thank you for replying. The latest update is as follows:

My plot was purchased from a cooperative society back in 1996 and was mutated by GDA in the same year under my name. As per the reply from GDA after multiple follow-ups and reaching out to the secretary, it is stated that cooperative society has still not paid some dues to GDA since the plots were allotted to general public. Now, there are multiple cases filed by GDA against such cooperative societies and they are holding up the mutation of plots to new buyers (resale plots).

I do have the right to start construction on the land as plot is registered in my name with valid site map approved by GDA, but I am not able to sell my plot to new buyer because GDA refuses to mutate the property in the name of new buyer.

Also, GDA was accepting mutation of resale plots till 2008, but they are adamant to not proceed with new mutation applications for resale plots specifically society plots due to their disputes with respective society.

In my case, the cooperative society has become dormant/non-functional and hence, I am not able to reach out to any person from their end.

Please suggest an expert advice on this case and if I file a lawsuit against GDA, what are the chances of getting this matter resolved at a quicker pace.

As some court cases are pending in court, your application cannot be entertained. Without permission, you cannot start construction. Postpone the construction to avoid legal issues.

Recording of mutation by GDA has nothing to stop you from selling the plot since you have the title and physical possession.
Besides this, you want to transfer title of the plot (by sale transaction) you are the absolute owner , i.e., only and only competent person to sell / transfer it to intending vendee (purchaser). It is not concerned with recording of mutation with GDA.
The subject plot was not sold (to you) by the Cooperative Society, which is stated to have become defunct/ dormant. However, a cooperative society shall either be operative / functional as per State Cooperative Societies Act /Rules or shall be liquidated /amalgamated but cannot remain defunct / dormant as stated by you, recheck the fact.
Some vital information is missing in the post, accordingly it would be appropriate to consult and engage a local prudent lawyer for proper analyses of fact /documents, professional advise and necessary proceeding.

The facts posted are rather disjointed.

Was it the GDA which allotted the plot to the so-called Cooperative Society? Was it freehold, if not, what were the terms of allotment?

Had the GDA granted you NOC for purchasing the property from the Society?

The sale transaction is yet to take place. As such why you are so concerned about prospective mutation?

What is the status of GSA? Is it entrusted with revenue functions? Is it not for the revenue authorities to carry out the mutation?
