Fir in advance

(Querist) 28 February 2024 This query is : Resolved 
AS CBI REGISTERED FIR ON 30.11.2023 AT 10.40 AND INDICATED THE INCIDENT WHICH WAS HAPPENED ON SAME DAY i.e. 30.11.2023 at 16.00 .
on that BASIS CBI arrested me , i approached HIGH COURT for quashing of FIR under section 482 ,
Experts kindly guide me

thanks sir , now I am on regular bail , CBI yet not submitted chargesheet , case is pending with highcourt since 11.1.2024 my lawyer submitted precipe for early date for hearing

If the CBI has not yet filed the charge sheet then there are very less chance for high to consider your petition to quash FIR.
If your advocate has already submitted an application to the registrar then you may have to wait.

Sir, we have already filed but hearing date is pending as pre admission stage from 11.1.2024

In that case it is advisable that you withdraw the current petition and file the quash petition subsequently after the cbi is filing the charge sheet with reports before trial court in order to challenge the same before high court in the form of quash petition.
