Rectification on sale deed

(Querist) 07 April 2014 This query is : Resolved
Draft Sale Deed was vetted to the Sub Registrar (SRO) for assessment of Stamp Duty. As per assessment by SRO necessary stamp duty has been paid, Sale Deed was executed, and presented for Registration. The SRO rejected the registration, stating that possession of the property has been taken over u/s 10(6) of the ULC Act. After that, we got a favorable order from High Court wherein the High Court said the possession has not taken over u/s 106) of the ULC Act. Now, when we are re-presenting the Sale Deed for registration, the SRO is saying the Sale Deed is under stamped, pay additional stamp duty and re-present the document. The SRO is saying his predecessor has done assessment wrongly. The fact is one of the boundaries is shown as PWD Road in stead of Road. The SRO has visited the site and realized that the description in the Sale Deed is wrong. However, the SRO is saying we have to pay stamp duty as per the wrong description of the property shown in Sale Deed, and we can not rectify the same. What are the legal recourses to us ?
