Quashing of charges.

If the framing of charges is more than two years, can we request the court to quash the criminal prosecution for want of time barred? (It is almost 8 years now)

Dear david ,it is perfectly deals with the section of 468 of crpc and it may be noted ,the bar stipulated regarding to taking cogizance after lapse of the period of limitation.

I had just verified. 468 crpc is to be operated wherein the maximum punishment of the offences is 3 years for any or all the offences. In this case the maximum can be counted even 50 years in such a way false case has been drafted in connivance with the very scamsters by the Premier Investigation Agency.

it is also settled by the law that ,there is no limitation to take coginazance if the offence precribed more than 3 yrs....

its the hardfact you have to digest it. You can even approach the high court by filing a petition for quash the proceedings.
