Refund from builder

I booked a flat with M Tech builders for Rs 1.3lacs. Now I want my money back as project does not sound good. I have two queries.
First, I have lost the original receipt but I have xerox copies and other details of payment. How can I proceed?
Second, the builder asks me to get a 'No Objection Certificate' from the property dealer thru which I booked the flat whereas that dealer is not accessible. Is it a valid requirement? Why this is required at all?
I shall be greatful to you for an early response.

File a consumer complaint settingout your grievances. You dont have to file original receipts in a consumer complaint and the photocopies you have with you will be sufficient. If the bulder issued the receipt to you then he alone is liable to repay the amounts. Obtaining No Objection Certificate from the property dealer is not mandatory but the builder is playing procrastinating techniques. Approach the consumer forum. You will sure get your money back along with interest in no time. Regards Srinivas BSST

How have you paid the money cheque or dd, if one these, proving your payment is easy. NOC may be needed to settle the interse commission to the property dealer.

And for Sh Kotresh's question,
I paid the money through Cheque and I have the bank's entry. I can prove that the payment was made to this builder.

certainly. Do obtain a certified copy of account statement from your banker pertaining to the month in which the cheque has been presented for collection and honoured.
