I, have been officiting in a sanctioned post for the past 2 years which fell vacant in August 2009, I have been doing the job two years now without a break. The post as it is, is a technical post and I have been the top most candidate till date. But what I am dismayed and wondering is that it has not been confirmed yet, thereby depriving of me of my employees benefit under the state government rules. Kindly suggest and advice.

If ur in Govt Job in which state r u? . If in Maharashtra then the state Employees Rules has the details. It is like you have to do 3 years of probationary service before having been said to be permanent. this 3 years would be of probation and every year you would be issued fresh temporary appointment letter and finally permanent appointment letter after 3 years of service. So it is two years now. but you have to look into the matter as they may keerp up under contarct which means you will be a temporary person for years together.

Even though you are working in a sanctioned post for the past 2 years and mere working in a officiating post does not confer any right on that post to you. Lien i.e., right to hold that post will be accrued only after declaration of completion of probation successfully. After declaration of completion of probation, the post which you are holding is called substantive post. You will get confirmation only after declaration of completion of probation. These are general rules in the government departments.
