Death of a probationer

Respected experts, Please let me know whether a person while he is working in his probationary period for a company dies, will get his benefits as other workers of the company. Please let me know about the case laws if any on this matter.

The probationary period is part of his service to the company. He will be treated at par with the confirmed worker in terms of death claim. For more details please Labour laws.

Under the Employees' Compensation Act(Earlier Workmens' Compensation) Act, there is no classification of employee as permanent, temporary, casual or probationer etc.. In case, any employees sustain any injury or died during the course of his employment, while performing his duties, he is entitled for compensation from his employer under the Act. Similar provision are in ESI Act too but in this case liability to make payment is of ESI corporation.
