(Querist) 01 June 2010 This query is : Resolved
Can anyone let me know that "Whether a service agreement can be revoked before its execution date, if it is signed on a prior date."?...

If yes than how?...

Looking forward to any reply.

Thanks Mr Sawant for your valuable response.

Please let me know one more thing that although if a clause is there in the agreement but what about the case IF:-

Second party intimated the first party about the inability in joining to first party at very early stage of signing offer letter and service agreement.

Second Party has informed First Party on just second day of signing offer letter and service agreement. While the execution of service agreement were about to begin on exact one month from the date of signing the service agreement.

For revoking the service agreement Second Party has made a intimation with mail on second day of signing the agreement, also made a second remainder(With registered post) on 3 days later to first intimation with clearly stating about disagreement and cancellation of agreement between First Party and Second Party, while the execution date of agreement is still yet to be come.

Waiting for any response. Thanks.

Since you have revoked the agreement by giving proper notice (through registered post), the said agreement is not enforceable.

Thanks a lot Subramanian Sir, that is what I were looking for.

Many thanks to you, you gave me a lot of confidence by stating in support of my decision.

thsi all depends about the relevant clauses of the said agreement..
if there are contrary clauses, your letter cancelling the same shall loose legality..
so go through the agreement carefully.
