Dear Sirs,
I own a residential flat which has been let out on LEAVE & LICENSE(L&L) AGREEMENT of 11 months which has been duly registered with the appropriate authority. The agreement is due to expire soon.
Sir, if the same LICENCEE is interested to continue and I too have no problem, we will definitely have to enter into a fresh L&L agreement. As such, I have some simple queries for which I request for your early response.
Whether it is a MUST that the stamp paper for preparing the agreement is purchased in the name of LICENSEE only? I think it should be so as usually the 2nd party does the agreement with the owner.
When can a fresh L&L agreement be entered into & registered. Whether it can be done before expiry of the existing License period with the subsequent 11 months' duration or it has to be done only after the expiration of the ongoing L&L agreement.
Whether a new agreement can be effective immediately from the next day of expiry of the present L&L agreement or it is essential to give a break in between the two? If yes, of what duration?
Maximum for what period a L&L agreement can be entered into?
If the flat is with a joint ownership with my name being the 1st and the wife's(housewife) being the 2nd, is it alright if the L&L agreement is entered into & signed singly by me with the licensee, I being the FIRST OWNER of the property? More so, as our property is in one city, we are in some other city, my job being transferable one and hence we find it difficult to jointly go everytime to do the L&L agreement formalities.
Also, when a L&L agreement is entered into within how much maximum period should the same be registered?
In continuation to the above,
1. can somebody clarify as to whether the new agreement can be continued from the immediate next date of the expiry of the ongoing agreement?
2.Whether the new agreement can be entered into even before the on going one expires with the subsequent date?
3.Whether I need to give some kind of intimation to the LICENSEE in advance (whether he is interested to continue or not) that the agreement is due to expire on so & so date so whether he is interested to continue or not or some such kind of communication, at least be email?
4. Has the online registration of L&L agreements started in MUMBAI?

Eveery 11 month the LL. Can renew is safer partt of both party. Particularly for owner. So better to approch local lawyer and follow accodingly

stamp paper can be in name of Licensor or licensee . it shouuld be done on expiry of agreement . not necessary to give a break between 2 agreements . your lawyer will do the needful
