Daughter's children right over metrnal ancestor property

(Querist) 29 May 2013 This query is : Resolved
If girl is married long time ago ( much before 2005), is even then the married daughter can claim her right on her father's ancestor property?

Further, in case the married daughter has died before caliming her right over ancestror property, is her childern can claim their right over their metranal ancestor's property?

Everything will depend upon whether or not the property is "ANCESTRAL" or not in the first place.

You have to first give the ownership of the property right from the beginning and as to how, when and from whom it came to the hands of the girl's father.

Only after knowing the details it will be possible to give an appropriate answer to your query.

You have not mentioned when the father of such daughter died.

If he died after HSA 2005 then she is duly entitled to claim her equal share in the ancestral properties otherwise she has only right to maintenance prior to that period.

Similar provisions are applicable in case she died prior to her father.

Thanks for replying.
Further clarification which are sought of are as under ::

The Property is ancestral.

Father of the girl has died prior to 2005. And property is owned & controlled by the son.

In Case daughter died, can her children claim any right on property or right of maintenance?
