Hi All,
Our society is in receipt of legal notice from Mira-Byhander Maganagar Palika stating that we need to make society land in our name (society) if we won't do that than in the event of building collaps due to natural clamaties or human effort than builder will be the legal owner of the land & we are no where, now my question is followong
1) while we buy the flat & registered the same than we just buy material only or price includes the land cost also?
2) under which section of law this notice or rights evoke
3) does we need to make land registered in our name & how? if yes than we need to pay anything to builder?

1. the part and parcel of the land in full
2. it is civil law the respondent superior it a law. owner of is liable for all the consequences.
3.subject to your registration and stamp duties prevailing in your state.

ANSWERS: [1] IT INCLUDES LAND
[2] Your contract, but you cannot get better title than that of a builder.
[3] YES, you get CONVEYANCE of Land in Society name. you pay registration and stamp duties payable , (- whatever you already paid).
Issue Notice to builder for conveyance,under MOF Act Sec 11, for Conveyance.
If he do, well and good, if not, go for deemed conveyance or court, cc, to get court order.

Stamp duty & registration fees paid by individual society member while purchasing flat, still we need to pay over & above that in order to registered land in society name?
