Tranfer of vehicle documents on sale

My son sold his two wheeler to a garage fellow without getting the form 30 signed by the buyer,who promised he will get this in a few days.This happened a few months back!The RTO is not accepting form 29 which is signed only by the seller.Even the delivery note given by the buyer is not acceptable.The RTO privately told me ,I can lodge a complaint to the Police of theft of the vehicle and the fellow will certainly come round!Is this o.k.?
I am worried that the vehicle is still in the name of my son and any mishap could land my son in trouble.
I have also requested the garage fellow that I will share some expenses like Insurance etc.And warned that the consequences will be serious if he does not do the transfer imm..Seeing me he has promised he will needful in a week.Can I resort to what the RTO privately advised me so that at least there will be a record in Police books!

Better inform the Fact in writing to Police, so it will be on record that u r not using it.
You should have taken even a mobile photo, video, record of your deal to protect you.

Can ask Police to call garagewalla, get his statement whereabouts of the vehicle.

Reporting of theft at this late stage is not advisable. You can however, report to police with a copy to the Tarffic Police and the RTO, as if the two wheeler was taken on loan by the garage fellow and is not being returned now, and that only he should be held responsible if any instance of misuse or accident is noticed on his part. You may also request that the party may be compelled to return the MV. Atleast the Traffic Police Deprtment would be able to take a notice of use of MV without registration in his name.

This would definitely help you to get the buyer moved for transfer to his name.
