Transfer Matters

(Querist) 15 June 2011 This query is : Resolved 
Sir,
Generally courts are not interfering in transfer cases of government employees due to some judgements given by the apex court. So the authorities are transferring their employees with malafide intentions whenever required in the plea of administrative exigencies. Can you give me some references of judgements of any court in which the transfer orders of employees have been quashed due to any type of irregularities found.

Dear Mr. Mishra,
Each organization has its own transfer policy. Only when any officer is transferred in violation of the transfer policy, or indiscriminately at short intervals, or singled out for such transfers while others not being disturbed, or if mala fide could be proved beyond doubt, the Courts will come for rescue, otherwise not.

Mr. Ramachandran is right.The apex court will also not say that courts cant interfere in any circumstance whatsoever.
