Gratuity Payment

Sir, I have one question, i had worked 05 Years in a company and i have asked to release my gratuity payment but the management is told that they are not started to give the gratuity payment to any one, so what can i do kindly sujest me to get the gratuity payment.

yes, you can applicable to gratuity, if they are not give, you can approach district employee division

The payment of gratuity is not the sweet will of the employer. Section 5 of the Payment of Gratuity Act, 1972 mandates that gratuity shall be payable to an employee on the termination of his employment after he has rendered continuous service for not less than five years on his superannuation, or on his retirement or resignation, or on his death or disablement due to accident or disease.

You serve notice on the employer calling upon to make payment of your gratuity amount and on his failure, you may file an application before the Controlling Authority of the area.
