Streedhan Claims

Guest (Querist) 01 March 2011 This query is : Resolved
IMy wife filed a 498A/406 charge on me and my family. I took a stay from HC from arrest. The case was refereed to mediation. In my first mediation session there were false claims by her that all her streedhan is with me and my family. There were not so many items that she claimed.

I agreed to few that I have and showed my willingness to return bt she is claiming a lsit that wasnt there. This will lead to the mediation failing and I would need to secure a regular bail.

Can you suggest do her false claims impact the bail plea after chargesheet. How the trial progresses will the Magistrate ask me to return articles that I dont have with me.

Dear Anonymous,
The wrong and frivolous allegations made by your wife will be tried by the court at the time of trial but to ensure your presence the procedure prescribes that you have to be bailed out. What ever list your wife is relying upon needs to be proved then only she can stake her claim on these Stridhan articles.

Best regards

You may face problem only in your bail, but not in main trial.

I have to take bail on chargesheet as I have a stay upto chargesheet. The charge is recently filed so will bail get refused on 406 Charges. The other side can contend any point to get that rejected as I dont have the items that they are contending.
