Querist : Anonymous (Querist) 28 December 2010 This query is : Resolved
Mr. "ABC" is married with a daughter. His wife Mrs. "XYZ" was put under severe torture and physical harrassment and as a result her family got their daughter ("XYZ") out of their family and she never returned for anything not even her daughter. Though the seperation was not legal as the divorce was never done.

This Mr. "ABC" who is a notorious fellow made fool of a young girl "DEF" by acting as a caring father of his young daughter whose mother left him. And he married the young girl by eloping with her without the permission of the girl "DEF"'s parents and family.
Of late Mr. ABC has been harassing the girl's family by talking abusive language on phone and shouting and creating scene near the girl "DEF"'s home whenever they go there.

Girl DEF's father wants that his girl is out of the hands of this notorious person and also that he stops his non-sense against anyone from his family. Please advice what steps should be taken by him and what are the kind laws will help him in that?

The marriage of DEF with ABC is void since it is bigamous. You can lodge a police complaint to bring DEF out of the clutches of ABC. If there is no action, file a writ of habeas corpus in High court which will get you back DEF immediately.

To get back the bride is not the solution. A case of cheating punishable u/s 420 is the only option.
