Sec 6[3] states "where a hindu dies after the commencement of -------- as the case may be."
I have 2 brothers and 3 sisters. Our father has died in 1974. No will has been made by him. He has a share in the joint hindu family. Will the provisons of Hindu Succession amendment act 6 be applicable in our case as our father has died before the commencement of this act ?

Father dying in 1974 but the legal heirs arew yet to sttle the estate as per HSA - could it not be the actual time when 5 of the heirs initiate settlement of succession

Thanks Mr Singal. My question is @ applicability of HSA amendment of 2005 when a hindu male has died much before this amendment ! As sec 6[3] starts with "where a hindu dies AFTER the commencement of----". So in our case will the provisions of HSA 1956 or the provisions of HSA amendment 2005 be applicable? Pls clarify,
