eviction from commercial

(Querist) 07 May 2010 This query is : Resolved
landlady has filed an eviction petition on a commercial property u/s 14(1)(e)Delhi rent control Act can any one send me a citation which favors tenant under such circumstances.
H. S. Thukral (Expert) 08 May 2010
As is evident the eviction petition has been filed on the basis of bonafide needs. Your only defence would be that the need is not bonafide and the landlord has suitable alternate accomodation to meet her need. As such citation, without facts of the case, can not be provided. Trial under section is summary trial and the tenant has to file an affidavit seeking leave to defend within time limit.

Will you tell the facts of the case? Case law applies to facts only.
