property dispute

Person has given his house to a family known to them as they were facing some financial problem....without any rent or any sort of agreement...... Now they want their house but these people are not giving possession....what action can be taken....any suggestions?

Try to have an amicable solution as legal steps are time and cost consuming.
If no solution possible consult local lawyer.

He has given to a known family and he should be in a position to settle it amicably without judicial intervention. If judicial process starts it would take long time and the owner cannot do anything till the case reaches to a logical end.

if they are not giving possession ask them to enter into regd leave and licence agreement for specific period . on expiry of period if they fail to vacate file suit for eviction

thank u for time in replying to the query.....should he file an FIR with police for trespassing....and what steps to be taken for avoiding any mortgage of this property

Police complaint for trespass will not be maintainable. Instead consult your lawyer and file an eviction sit on the basis of caretakers squatting illegally in the house and refusing to vacate on demand, for avoiding mortgage, you may file an IA in the suit restraining them from indulging in any such activity.
