T. Kalaiselvan, Advocate (Expert) 28 June 2014
The property was inherited by your grandfather from his father and was in his possession and enjoyment as an absolute owner. This empowers your grandfather, as an absolute owner of the property, to dispose it in any manner as per his desire. Thus, your grandfather, who adopted your uncle as his son, after having married off his three daughters, settled the property on his name in favor of your uncle and your uncle has mutated the property on his name in the revenue records or disposed the same on his own without seeking the consent of your mother or other aunties. This is legally valid. Your mother or her sisters are not needed to be consulted or their consent is required to dispose this property lying on your uncle's name Your mother or her sisters do not have any right or interest or share in the said property hence getting misguided to file a partition suit is nothing but a mere waste of time, energy and money. Consult a local advocate and proceed as per his advise.
