Civil suit on partition

One of the defendents is not receieving the summon , while others filed the vakkalathu. What should I suggest to my lawyer to bring the case on trial ?

Shall I approach the higher court in Chennai?

or
Publish in news paper thru court, if address changed
or get "refusal" report of summon
