Partition deed

My father died without wrriting will,we are three (myself,sister ,brother) children and my mother is also their.we have one house which is on my fathers name.after my fathers death my brother is not talking with me,my sister and with my mother.how we will get the partition deed?i want some suggestions .how we can proceed for partition deed?

If mutual partition is no more possible then file a suit for partition to claim your share.

1) Ask your lawyer to talk to him to find out whether he is willing to make the partition mutually or not,

2) If not, file a suit for the partition of the property.
