When can a member be declared as a defaulter in a housing society? Suppose a member does not pay maintenance bills for 3 months then pays in 4th month in such case would he be defaulter for past three months and ceases to be defaulter in 4th month? It is said that defaulter can not become office bearer. Suppose a secretary, after election, fails to make payment for certain period then does he become defaultr? and in such case what wii happen to his post of secretary?

In our society where I am a treasurer, our Secretary has not paid maintenance bills of Society for 3 months. Other members are saying that he should resign as a secretary as he is a defaulter. Actually the Secretary pays all his dues after certain months, but again fails to pay for next few months.
This query is raised in this particular situation.

All those acts which are in violation of the bylaws of the society are considered as default.
The non-payment of maintenace is also default, even if maintenance for certain number of months are paid together after the delay. You could have intimated the managing committed in advance if there were any difficulty to pay the amount in time.
It is to be noted that the bylaws are bound to be followed.
