dear expert i am a junior advocate and i am sending u draft of indemnity bond which i have draft for my client , he want to withdraw p.f amount of his deceased father please check it and let me know whether it is correct or not and is it necessary to furnish 2 sureties in the indemnity bond along with witness
Indemnity Bond to Enable the Concerned Government Authorities to Pay the PF Amount of deceased to one of his Legal Heir
I Suresh Keshav Sultha adult, Indian Inhabitants, residing at Kalash Nagar Room.no 17 pipeline, Mumbai 400 087, do hereby solemnly affirm and state as under:-
My father Mr. Keshav Dharma Sutan died on -----------and left behind him the following legal heirs.
Name Relationship
(i) Ramesh K Sutan E C no. 1676901 Son
(ii) Santos Son
(iii) Harshali Chandrkant Kolekar Married Daughter
(iv) Suresh Keshav Sutan ( My Self ) Son
Legal heir 1 and 2 and 3 are my brothers and sister.
And Whereas the above said legal Heir are the only legal heirs and representatives of late
Shri Mr. Keshav Dharma Sutan who died on 7th/08/1998. As my mother is already expired during my father life time on 08/10/1997 death certificate of the my father and mother is enclosed here with
And whereas my father Late Mr. Keshav Dharma Sutan was Hindu and governed by The Hindu law. I hereby state that save and except above legal heirs there are no other legal heirs and representatives of the My father Late Mr. Keshav Dharma Sutan .
And whereas my father was working as a Labourer in p south ward and his employee code was________and his P.F Account No. is __________
And whereas being legal heirs I and my above said brother and sister ( Legal Heir no1 to 3 ) are a rightful claimer of the my father P.F Amount.
And whereas legal heirs no 1 and 2 and 3 are my brother and sister and they are not interested to claim in the P.F amount of my father and they are giving their No Objection Certificate to enable the government authority to pay my father P.F amount to me N.O.C of the legal heir No.1 to 3 are enclosed here with.
I am executing this Indemnity-Declaration to enable the appropriate Government Authorities and other authorities to pay My father Late Mr. Keshav Dharma Sutan P.F amount to me .
I agree to keep indemnified and hereby indemnify and keep harmless the appropriate Goverment Authorities including their office - bearers, employees, staff and their successors from and against any loss, damage, demand, action, dispute, claim, costs, charges and expenses of any nature that may be suffered or sustained by them on account of their act/s and steps taken to pay my father P.F amount to me.
IN WITNESS WHEREOF I Suresh Keshav Sultha the applicant herein have signed and set my hand on this 12th day of October, 2011.

Dear Anita,
The draft indemnity bond is generally ok.
You have to make the following corrections (given in BOLD letter) in the draft.
And whereas legal heirs no 1 and 2 and 3 are my brother and sister and they are not interested to claim in the P.F amount of my father and they are giving their No Objection Certificate to enable the government authority to pay TO ME THE P.F. AMOUNT STANDING TO THE CREDIT IN THE ACCOUNT NO. ...... OF my LATE father Mr. Keshav Dharma Sutan. THE N.O.Cs GIVEN BY THE legal heirs No.1 to 3 are enclosed here with.
I am executing this Indemnity-Declaration to enable the appropriate Government Authorities and other authorities to pay TO ME THE P.F. AMOUNT STANDING TO THE CREDIT IN THE ACCOUNT NO. ...... OF my LATE father Mr. Keshav Dharma Sutan.
There may not be need for sureties. In case the authorities insist, then you have to give the sureties.
