hello everyone my father died 3 years back.so i am left with my mother and brother.we've land in my father's name(urban land).we wish to register this is in our mothers name.i know that grandma is also entitled for a share.my question is we already hav a legal heir certificate where it is mentioned only about us(no grandma's name).i wish to register in my mothers name as i am leaving abroad for further studies.do i have to go in for a new legal heir certificate now.. or can she come n sign without her name being in legal heir ceritifacte.. wat r the documents required ?my grandma is not interested in d share as she is knows d value of hard earned money .. money was to children .. dat is us.. kindly reply as early as possible

Yes, you should get fresh legal heir certificate in name of four person(your mother, ur grand mother, your brother and you) to avoid any unleasant situation. If all three (ur grand mother, your brother and you)are ready to give your share to your mother, there will no problem in getting that land registered in name of your Mother. You all can relinguish your share in favour of your mohter.

So to register land u need to have legal heir certificate rite?can my grand mother give her consent without her name being in certificate.am leaving in 4 days to usa.not possible to get certificate.is der a way out?

yes, your mother can give her consent even without her name in legal heir certificate.

pls clarify while getting property transferred in queriest's Mother's name, he has to show succession certificate or not? I am a lillte bit confused with your opinion.
