Abettment to Suicide

Hi Experts,
My brother had committed suicide on 16th February 2011.
My brother has left a wife and a 2-month old baby.
On checking his phone records, we found some threatening/mental torture/obscene messages from an unknown number. Later I, along with the police officials, traced the number and found that it was one of our family friend who my brother might had a relation ship with, in the past. Also prior to his death, he had confided to 2 of his friends that the concerned girl was mentally harassing him and blackmailing him for commitment. The police have taken the statements of these 2 friends. The Police has recorded the girl's statememt, without displaying that she is being considered as a suspect, in which she denied having any recent coversations or any untoward relationship with my brother. But even the police have identified that there are suffient electronic proofs to prove otherwise.
The police have advised me that she might get arrested under 306 if I filed an FIR, but the case stands very weak in front the court and that she might get acquitted quite easily.
My entire family is distraugt and moreover we all have always treated her as a sister/daughter. She still comes to our house and acts like sister/daughter. Kindly suggest me for what I should do? I am too disturbed.

WHY THE POLICE HESITATE TO FILE THE F I R AGAINST HER, YOU SAID MUCH EVIDENCE WAS HAVING YOUR POSSESSION THEN WHY DONT YOU WAIT IMMEDIATELY FILE THE CASE AGAINST HER, THE SAID POLICE WILL NOT FILE THE CASE AGAINST HER YOU MOVE THE HIGH COURT DIRECTION THROUGH ONE ADVOCATE.

Hi,
Thanks a lot for the reply.
The police are saying that they can act on the girl and arrest her once I file FIR against her. But at the same time they are warning that the case stands very weak for section 306.Moreover since my brother has not left any suicide note, they are saying that it will be a cake walk for the girl to get acquitted.
Should I hire an advocate and file a FIR against the girl?
