Accident case with LLR License

"X" is rider of the vehicle and having valid effective LLR License. "Y" is pillion driver and having valid effective Driving License. "Z" is Pedestrian.
"X" hit to "Z". "Z" got injuries and filed a case u/s 338 of I.P.C. and Motor vehicle act, claiming compensation.
My quarries are
1. "X" want to show liability on Insurance company only to pay compensation to "Z".
2. "X" is poor person, hence "X" want to escape from liability.
3. Please provide any citation or section of law to show liability on Insurance Co only.
